Regulations of games on Laser Arena
By deciding for a reservation of a game at Laser Arena and deciding to participate in the game you accept the rules within these regulations.
- Laser Arena, further known as “the Object” within the regulations is led by Kamil Zalewski under the name: Magnum Kamil Zalewski with headquarters in Gdańsk, Siennicka 25B street, 90-758 NIP: 95710551159, further known as “the Organiser”
- Recreational sports activity is led within the Object in the form of organised shooting using Laser Tag, falling within the scope of training, schooling and tournaments (further as “games”)
- The Customer (Customer, people staying within the building either as a Participant or an observator) making a reservation accept the established rules within these regulations by making signing their surname under the regulations, right by the entrance to the building (Reffering to clients that are of age). When it comes to underage clients knowing the Regulations is to be confirmed by their parent or legal guardian, or the adult person which they are under the care of while within the Object. Before entry of the Object Customers and their caretakers are to acknowledge the Regulations. The Regulations are set in a visible and accessible place within the Object for every real or potential Customer.
- In the instance of an underage group participating within the game, every Participant has to give us a written consent form signed by a parent/legal guardian. Within the consent form there should be visible agreement for the child to participate, including the full name of the child, with a clear signature of the parent/legal guardian that includes at least their surname.
- In the responsibilities of the Instructor which leads the game there is: introducing and reminding about safety rules, taking care of technical issues, proper preparation of the Participants and telling them of the basic game rules, as well as leading the game.
- To be a Participant of the game, a person has to be 7 years old minimum. The child’s age will be checked via their school ID or other legal ID form (like a passport), which gives us a clear look at the age. In the instance of a game in which the participants are both children and adults, it is only allowed if the adults are their parents or legal guardians.
- Because of safety precautions, the minimum height of the participant is 105cm. The height will be measured by the Instructor before the agreement of the person participating within the game.
- Within the Object participants are to keep by the regulations, notes or commands from the Organiser or Instructors, signals, the whistle signal, as well as keeping in regulation while preparing for the game.
- It is up to the player for the footwear to be appropriate for them and for the physical activity they will be taking part in.
- It is forbidden to put the barrel of the gun directly against another person. hand-to-hand combat is forbidden, hitting someone or a part of the infrastructure with the gun is also forbidden. It is forbidden to grab someone else’s gun, or using the gun for any other purpose than shooting or aiming. It is forbidden to shoot without looking or reaching with your gun alone behind walls, so called “blind shots”.
- It is forbidden to run, climb the walls or other infrastructure within the playground, going to other playgrounds than it was established at the beginning of the game, as well as any other behavior that could end up in harm for the body of the Customer or any other participating people. The Organiser does not take responsibility for any injuries caused by refusing to follow the rules above by the Customer/Participant.
- The underage people can only be on the premises of the Object (before the playground area or aside from it) only under adult supervision.
- The Participants should start the game after the whistle, and immediately stop playing after the whistle signal. The start of shooting is only allowed after a clear signal from the Instructor in the form of the whistle signal. The Participants should take utmost caution while on the playground or before it at any moment.
- The Participant’s responsibility is to inform the Organizer about existing issues, malfunctions or damages they notice. The Participant is to inform the Instructor or the Organiser immeidately if any accident takes place within the playground, especially in the case of bodily injury or injury to the Object’s infrastructure, stopping the game at the same time. If the situation requires it, the Participant is under the responsibility to give first aid until the help from the Organiser comes.
- The Participant takes full civil and legal responsibility for any personal damages or material damages caused by themselves, on purpose, while participating in something within the Object.
- The Organiser takes no responsibility for the aftermath of any accidents that were caused by Participants not abiding by the rules, the notes and commands of staff. In addition to that, the Organising party has no responsibility in replacing previously rented gear that has been damaged by the Participant on purpose.
- The Object is monitored visually with the purpose of safety and protecting the Clients, workers and the Organizer, as well as the object. The recordings are being stored for a period of 5 days, unless the recorded view is to be used in a court case. Then, the period in which the recording is kept might be longer. The Client or Participant should immeidately notify the Organiser about the need to use the recording together with a reason, not later than in a 48h period from the moment which could have been recorded. After the 5 day period the recordings will get overwritten by new recordings.
- The Client or Participant gives us the right to publication of their image or silhouette that could have been recorded during the game on the Organiser’s website, unless they provide us with their refusal through mail, written form or verbal form during the making of the reservation. Every Client or participant has the right to see their personal data collected during the game by the Organiser, as well as to the material getting deleted to which contain their image; as well as the right to wanting them fixed up or deleted.
- The Administrator of personal data of Clients as well as game Participants is the Organiser.
- Reservations – to confirm a private reservation the Client has to pay a deposit to the Organiser. The definition of deposit from the Civil Code applies. The paid-in amount gets applied to the count of the full price. In unique circumstances it will be allowed to move the paid in deposit to a different game at a date that suits both the Organiser and the Client. Paying in the deposit is equal to confirming accepting the regulations of the game and the conditions of the reservation.
- In unique situations the Organizer may revoke the right to participate in the game a person who doesn’t listen to the rules nor the instructors leading the game. The observing people who do not apply to the safety regulations as well as the Instructors will be asked to leave the playground or the viewing veranda.
- The Organiser has the right to remove people from the object who disturb the peace or the public, or who are dangerous towards themselves or other people within the Object.
- Smoking and E-Smoking is absolutely prohibited within the Object.
- It is prohibited to take animals into the Object.
- Drinking alcohol is absolutely prohibited within the Object. The prohibition does not include the Party Room as it is an independent room within the Object
- The Participant is to ensure that they are not under the influence of alcohol, drugs, medicine or any other substances that may affect their reactions and behavior. The Participant also ensures that there are no other events that may affect their health during the game of paintball ASG negatively. The Participant ensures that there are no health risks thay may affect them during the game of paintball ASG, and states that they don’t have any injury, or other health condition, that could worsen their health because of them participating in the game.
- The Organizer may refuse to let a Participant play if there is a possibility of their health deteriorating because of participating in the game or if participating will create a real risk to the health status of the Participant. The refusal of a Participant joining the game can also be caused by being too short in their height, them being aged below 10 years, or height below 105cm.
- The Organizer will deny the participation of a Participant if there is a suspicion of them being under the influence of alcohol. If there is such a suspicion, the person will be asked for a voluntary test with a breathalyzer. The Participant has a right to saying no to the test and to ask for a test in the presence of a Police officer. The time spent waiting for the test done by the Police may affect the length of the game. The Client, or the Participant will not get any compensation or insurance due to them being tested in the format described above.
- The Participant, if found to be drinking alcohol during the game or within the breaks, within or around the premises will not be able to continue playing. In some cases the person may be asked to leave the Object. Every person matching this description will be asked to leave the playground or the area before it immeidately.
- Any infractions of the regulations relating to drinking alcohol remove the possibility to get the funds spent on the game back, as well as getting back the deposit.
- When it comes to situations not regulated within the Regulations the proper solution will be found using the civil rights as well as the regulations stated within the RODO decree.
- The Regulations apply since the 7th of March 2023 until cancellation
